TERMS OF SERVICE

Last Updated: 18/08/2026

Welcome to Headforahat. These Terms of Service (“Terms”) govern your use of our website, online store, products, and services.

Throughout these Terms, “we,” “us,” and “our” refer to Headforahat/ Colleen Dalzell. Our store is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products and services to you.

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms. Please read them carefully before using our website.

1. ONLINE STORE TERMS

By using our store, you confirm that you are legally capable of entering into a binding contract or that you have obtained any consent required by applicable law.

You may not use our products or services for any unlawful or unauthorized purpose.

You must not transmit viruses, malware, malicious code, or otherwise attempt to interfere with the operation or security of our website.

A breach of these Terms may result in the suspension or termination of your access to our services.

2. PRODUCTS AND SERVICES

We make reasonable efforts to display our products, descriptions, photographs, colours, specifications, availability, and prices as accurately as possible.

However, the appearance of products may vary depending on your device or screen settings, and minor differences may occur where products are handmade, pre-owned, customized, or otherwise subject to natural variation.

We reserve the right, subject to applicable law, to:

  • change or discontinue products;

  • limit quantities available for purchase;

  • restrict sales where reasonably necessary;

  • correct errors in product information; and

  • update prices and product descriptions.

Any product-specific restrictions will be stated on the relevant product page where appropriate.

3. ORDERS

Submitting an order does not necessarily mean that we have accepted it.

After you place an order, you may receive an automated confirmation acknowledging that we have received your order. A binding purchase contract is formed when we accept your order in accordance with the checkout process and applicable law.

We may refuse or cancel an order where reasonably necessary, including because:

  • a product is unavailable;

  • payment cannot be authorized;

  • information provided with the order is inaccurate;

  • we reasonably suspect fraud or unauthorized activity;

  • an obvious pricing or listing error has occurred; or

  • we are unable to fulfil the order legally.

If we cancel an order after receiving payment, we will refund the applicable amount using the original payment method where reasonably possible.

4. PRICES AND PAYMENT

Product prices are displayed in [Currency] unless otherwise stated.

Taxes, shipping charges, customs duties, and other applicable charges may be added or displayed during checkout depending on your location and the nature of the order.

We reserve the right to change prices at any time. Price changes will not ordinarily affect orders that we have already accepted.

You agree to provide current, complete, and accurate billing and payment information.

Payments may be processed by Shopify Payments or other third-party payment providers. Your use of those payment services may also be subject to the provider's applicable terms and privacy practices.

5. SHIPPING AND DELIVERY

Our available shipping methods, estimated delivery periods, and applicable charges are displayed during checkout or in our Shipping Policy.

Delivery estimates are estimates unless we expressly state otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, although this does not affect any statutory rights you may have.

You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect address or failed delivery may be payable where permitted by law.

For international orders, customers may be responsible for customs duties, import taxes, or other charges unless we expressly state that these charges are included.

6. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, exchanges, and order cancellations are governed by our Refund and Returns Policy, together with any mandatory rights available to you under applicable consumer law.

Nothing in these Terms is intended to restrict statutory cancellation, refund, repair, replacement, or other consumer rights that cannot legally be excluded.

Please review our Refund and Returns Policy before placing an order.

7. ACCURACY OF INFORMATION

We aim to keep information on our website accurate and current, but errors may occasionally occur.

Product descriptions, prices, promotions, shipping charges, delivery estimates, availability, and other information may contain typographical errors, inaccuracies, or omissions.

Where permitted by law, we may correct errors and update information without prior notice.

If an error affects an order you have already placed, we will take reasonable steps to notify you and provide any remedy required by applicable law.

8. PROMOTIONS AND DISCOUNT CODES

We may offer discount codes, promotional offers, giveaways, or other promotions.

Unless otherwise stated:

  • promotions cannot be exchanged for cash;

  • discount codes cannot be applied retrospectively;

  • only one discount code may be used per order;

  • promotions may have eligibility requirements or expiration dates; and

  • promotions may be withdrawn or modified where permitted by law.

Separate promotional terms may apply and will take precedence over this section where they conflict.

9. ACCOUNTS

You may be able to create a customer account.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorized access to your account.

Information supplied when creating or maintaining an account must be accurate and current.

Please contact us promptly if you believe your account has been compromised.

  • to collect personal information unlawfully;

  • to send spam or conduct unauthorized automated activity;

  • to interfere with security features;

  • to scrape or systematically extract website content without authorization; or

  • to attempt to gain unauthorized access to our systems.

We may restrict access where we reasonably believe these Terms have been violated.

You remain responsible for your content.

Our website may contain services, applications, integrations, or links operated by third parties.

These may include Shopify, payment processors, delivery companies, analytics providers, social-media platforms, or other service providers.

Third-party services may be governed by separate terms and privacy policies.

We are not responsible for independent third-party websites or services except where applicable law provides otherwise.

14. SHOPIFY

Our online store is hosted using Shopify's e-commerce technology.

Your information may be processed through Shopify and other service providers as described in our Privacy Policy.

15. PERSONAL INFORMATION AND PRIVACY

Our handling of personal information is described in our Privacy Policy.

By using our website, you acknowledge that information may be processed by service providers necessary to operate the store, process payments, fulfil orders, prevent fraud, provide customer support, and perform other legitimate business functions.

Where applicable, you may have rights concerning your personal information under data-protection laws.

16. WARRANTIES

We do not exclude or limit warranties, guarantees, or consumer protections that cannot legally be excluded.

Subject to those rights, we do not guarantee that our website will always be uninterrupted, completely secure, or error-free.

We may temporarily suspend access for maintenance, security, upgrades, or circumstances outside our reasonable control.

17. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude liability for matters that applicable law does not permit us to exclude or to limit your mandatory consumer rights.

To the fullest extent permitted by applicable law, we will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

If you are purchasing as a consumer, this section does not affect the legal protections available to you under applicable consumer law.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, liabilities, and expenses arising directly from your unlawful use of our website or your material violation of these Terms.

This provision does not apply to the extent that such responsibility cannot legally be imposed on you.

19. FORCE MAJEURE

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, subject to any rights or remedies that applicable law requires us to provide.

Such circumstances may include natural disasters, severe weather, strikes, transportation disruptions, telecommunications failures, governmental actions, or widespread service outages.

20. TERMINATION

You may stop using our website at any time.

We may suspend or terminate access where reasonably necessary because of fraud, unlawful conduct, security threats, or a material violation of these Terms.

Termination does not affect rights or obligations that arose before termination.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed where necessary.

The remaining provisions will continue in effect.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, services, technology, or legal obligations.

The latest version will be posted on this page with an updated “Last Updated” date.

Where applicable law requires advance notice or consent for a material change, we will comply with those requirements.

23. GOVERNING LAW

These Terms and disputes relating to our services are governed by the laws of United Kingdom, subject to any mandatory consumer protections that apply in your country of residence.
